Service Terms and Conditions

Terms and Conditions for Service Contracts between Temerian Marketing and Clients.

In the event of discrepancies:
If there is any conflict or discrepancy between the terms outlined on this website and those provided in a quote, the terms on this website shall take precedence.

Changes to Terms:
Temerian Marketing reserves the right to update, modify, or amend the terms and conditions on this website at any time without prior notice. It is the responsibility of the client to review the terms periodically for any changes. Continued engagement with Temerian Marketing after changes to the terms constitutes acceptance of the updated terms.

1. Payment Terms
   • Pay-As-You-Go Plan: Payment is due at the end of each week in which conversations occur. An invoice will be sent weekly and must be paid in full within 3 business days.
   • Retainer Packages: Payment for monthly retainer packages must be made in full before the first conversation of the month. Conversations will not commence until payment is received.
2. Late Payments
   • Payments not received within one (1) week of invoice date frame will incur interest at a rate of 1% per day, compounded daily, starting from the payment due date.
   • Interest will be applied until the outstanding amount is paid in full.
3. Conversation Definition
   • A "conversation" is defined as up to 10 text exchanges or 30 minutes of consulting within a single calendar day.
   • Conversations exceeding these limits may require additional charges or a new agreement.
4. Unused Retainer Conversations
   • Unused conversations in retainer packages will not roll over to the next month unless explicitly agreed upon in writing.
5. Refund Policy
   • Retainer package payments are non-refundable. If the client decides to discontinue the service, unused credits will not be reimbursed.
6. Scope of Service
   • This agreement applies only to text-based consulting. Additional services, such as project work or follow-up documentation, will be billed separately at $100/hour or $25/summary, respectively.
7. Disclaimer
   • The services provided by Temerian Marketing are limited to the time spent during text-based conversations and are not contingent on the subject matter or the effectiveness of the advice provided.
   • Temerian Marketing staff offer marketing support to the best of their ability, leveraging over 10 years of accrued marketing expertise. However, no guarantees or warranties are made regarding the specific outcomes or effectiveness of the advice.
   • The client acknowledges and agrees that they bear sole responsibility for implementing advice and making decisions based on the consultations. Temerian Marketing shall not be held liable for any direct or indirect results stemming from these conversations.
8. Confidentiality
   • Both parties agree to maintain confidentiality regarding all discussions and materials shared during the consulting period.
9. Termination of Agreement
   • Either party may terminate this agreement with written notice. Retainer package payments will not be refunded upon termination.
